Coque v. Wildflower Estate Developers, Inc. (Mr. Slater for the Plaintiff)

  • Settled by Mr. Slater in March 2009 for $9.68M dollars plus $120,000 "fresh money" contributed by compensation carrier after waiver of a compensation lien of $990,000 (after verdict and appeal).
  • Confirmed the legal right of undocumented aliens to receive compensation for lost wages in New York State.
  • While working on a condominium in 2001, a bag of roofing shingles weighing 40 lbs. through an open sky light and struck Coque in the back, causing the scaffolding on which he was standing to collapse. He fell 25 feet and broke his back, rendering him paraplegic.

Majlinger v. Cassino Contracting Corp. (Mr. Slater for the Plaintiff)

  • Stanislaw Majliner sustained serious physical injuries when the scaffolding he was standing on about 15 feet off the ground suddenly collapsed.
  • The Court of Appeals decided this case with Balbuena vs IDR Realty Inc, LLC  because both actions dealt with illegal immigrant laborers who were injured while working on construction sites and sued for lost wages.
  • The Court of Appeals ruled on Feb. 21, 2006 that illegal immigrants are eligible to recover lost wages that result from workplace injuries.

Siladji v. Rockefeller Center Corp. (Mr. Slater for the Plaintiff)

  • $2,148,760 jury verdict for plaintiff and his wife where plaintiff suffered neck and back injuries carrying a door that struck boxes that were being stored in a hallway of building managed by Deft Rockefeller Center
  • Justice Hon. Charles Ramos, Supreme Court, New York County.

Ortiz v. State of NY (Mr. Slater for the Plaintiff)

  • $1.618M verdict after trial.
  • Ortiz suffered injuries in an accidental shooting by an off-duty corrections officer.
  • Justice: Hon. Gerard Weisberg, New York State Court of Claims.

  • Settled prior to summations for structured settlement guaranteeing over $5M over course of Plaintiff’s life.
  • Plaintiff, a 3-year-old girl, fell out of her fourth-floor apartment window. Window frame was rotted and window guard was improperly installed
  • Mother was super of building where she lived.

  • Settled during trial for $1.95M.
  • Plaintiff injured while pouring concrete slab when building collapsed. He fell six floors and was struck by falling debris.

  • Plaintiff was injured when a stairway, in a building where he was working, collapsed causing him to fall.

Robert DelRosso v. The Hustle Disco a/k/a Chaz Disco (Mr. Slater for the Defendant)

  • Verdict for the defendant
  • Plaintiff was stabbed by allegedly intoxicated patron at bar
  • Jury found defendants violated Dram Shop Act and although, the joury found the defendant negligent, they determined that its negligence was not a proximate cause ro substantial factor in how or why the incidnet in question occured.
  • Trial Justice: Hon. John JJ Jones, Supreme Court, Suffolk Court.

  • $784,000 verdict at trial for EMS worker injured carrying patient that tripped on broken step.
  • Suffered Torn Meniscus requiring Arthroscopic Surgery.

  • Amount demanded of jury $500,000
  • Amount awarded $95,000
  • Plaintiff struck in head by broken piece of bedroom ceiling

Jeff Destefano, as administrator et ano. v. The City of New York, etal. (Mr. Slater for the Plaintiff)

  • Settled for 250k after opening statements in case where deceased, who had been arrested for intoxicated driving, fell in the holding cell of the Police Precinct in Queens, NY while unsupervised.
  • Was one of the largest settlements in New York State history for one hour conscious pain and suffering.
  • There was no wrongful death claim because.deceased passed away intestate (without a will), without a wife and/or children and his suviving mother passed away only two months after the event in question
